English Commercial Court accepts jurisdiction over asset recovery claim relating to the use of BVI companies

In Marex Financial Limited v Garcia [2017] EWHC 918, Mr. Justice Knowles has dismissed an application seeking to contest the jurisdiction of the English Commercial Court to try a claim for damages, relating to an alleged attempt by an individual defendant to asset strip in fraud of judgment creditors, through the medium of certain BVI companies.

The case has a long procedural history in various jurisdictions, and, reading between the lines, one is left with the impression that the Judge was not very much impressed by the alleged behaviour of Mr. Garcia, nor by his application.
