… but the Bermuda Court of Appeal also reminds Bermuda criminal defence counsel to take care when interviewing prosecution witnesses …

In his recent judgment in the case of R v Kamal Worrell [2016] CA Bda 15 Crim, the President of the Court of Appeal for Bermuda, Sir Scott Baker, reminded all Bermuda criminal defence counsel that “training or coaching witnesses in criminal proceedings is not permitted“, and he noted that what occurred on the facts of this case “seems perilously close to having breached this principle, if not having crossed the boundary“.
